Abstract
Sporazum o Svjetskoj trgovinskoj organizaciji (WTO) uspostavio je novu međunarodnu organizaciju. Ova organizacija ima pravnu osobnost, pravnu sposobnost, privilegije, imunitete i jači sustav za rješavanje sporova za sve članove. Sigurnosno tijelo WTO-a je tijelo za rješavanje sporova (DSB), koje je uspostavilo sustav za rješavanje sporova. Sustav rješavanja sporova smatra se temeljnom i središnjom institucijom WTO. Njegova je svrha rješavanje trgovinskih sporova između članica WTO-a i njime se uređuje razumijevanje pravila i postupaka, poznatog kao sporazum o rješavanju sporova (DSU), kojim se utvrđuje postupak rješavanja sporova. DSB i DSU WTO-a smatraju se jednim od najjačih funkcija WTO-a kao rezultat njenog cilja za rješavanje sporova koji bi mogli nastati među članicama u vezi s njihovim pravima i obvezama iz sporazuma o WTO-u.
Abstract (english)
The World trade Orgnization (WTO) agreement established a new international organisation. This organisation has a legal personality, legal capacity, privileges, immunities and a stronger system for resolving disputes for all members. The WTO’s significant subsidiary body is the Dispute Settlement Body (‘DSB’), which has established a system for dispute settlement. The dispute settlement system is considered a fundamental and central institution of the WTO. Its purpose is the resolution of trade disputes between WTO Members and it is governed by the Understanding on Rules and Procedures, known as the Dispute Settlement Understanding (‘DSU’), which establishes the procedure for dispute settlement. The WTO’s DSB and its DSU are considered to be one of the WTO’s strongest functions as a result of its aim to settle disputes that might arise between Members regarding their rights and obligations under the WTO agreement.
